摘要
解决商标权产品的平行进口问题应适用商标权的国际穷竭原则 ,该原则与商标及商标权的基本理论具有内在的一致性。商标权的地域性特点不能否定国际穷竭原则的合理性。同时 ,国际穷竭原则的适用也有利于市场的开放、贸易壁垒的消除、货物的自由流动。
The international exhaustion doctrine shall be adopted to solve problems concerning the “parallel importation”of products legally attached by trademarks.This doctrine has the same characteristic with the basic theories of trademark and trademark right.The territory trait of trademark right should not be taken to deny the rationality of international exhaustion doctrine.Its implementation will help open the market,eliminate the trade barriers,and make possible the free movement of goods.
