国外检察官考核考评制度之比较及启示

A Comparison of Foreign Prosecutor Appraisal Systems and Their Enlightenment to China

在介绍德国、英国、日本和美国等国检察机关特点和检察官考核考评制度的基础上,总结并归纳出各国检察官考核考评制度重视业绩考评、强调过程控制、注重考核结果应用等一般规律特征。我国检察官考核考评制度应在考虑国家性质、社会制度差异的基础上,吸收借鉴各国的有益经验和成果,体现检察官业务特征,与检察官整体水平相适应,并将过程控制与考核结果应用相结合,同时要重视考评体系和考评方法的科学性。

This paper summarizes the general rules of stressing performance,process control and appraisal result etc.of various prosecutor appraisal systems by studying procuratorial organs and prosecutor appraisal system of Germany,UK,Japan and US,and then suggests that China＇s procurator appraisal system should be established in line with its property of state and its differences in social system from other countries,via borrowing the experience and results of other countries.Such a system must confirm to procuratorial business and the overall procuratorial quality,integrate process control with appraisal result,and pay attention to the scientificity of the system and appraisal method.
