知识产权不仅对权利人个体的自我发展意义重大,更在于其作为一种资源通过在市场流通中进行的有效配置,在于其作为一种生产要素推动社会的发展。充分挖掘信息财产的流动性资源价值,促进知识产权的交易和传播,成为知识产权研究的一个重点发展趋势。遗憾的是传统的知识产权的客体观念和担保物权观念在不同程度上制约着知识产权的流通,知识产权的质押亦受到严重影响,树立新的知识产权客体和担保权的理念,以更注重自由、效率的债权规则来规制知识产权质权显得甚为重要。

Intellectual property plays a very important role in the development of our society. It is significant not only for the progress of individual, but also as a kind of resource for efficient allocation in the market. What＇s more, it has become a key developing trend in the research of intellectual property that making the most use of liquidity resource of information property to pro- mote the spread and trade of intellectual property. Unfortunately, the object concept of the tradi- tional intellectual property and creditor＇s rights, to some extent, restrict the flow of intellectual property . Thus the pledge of intellectual property is also severely affected. It is important to cre- ate a new object of intellectual property and creditor＇s rights concept, and to regulate the intellec- tual property right of creditor＇s rights with more free and efficient rules.
