环境监管失职犯罪之侦防研究

环境资源犯罪严重危及人类生存。环境监管失职是导致环境资源犯罪发生前提性因素,因此要从源头防止此类犯罪的发生。尽管刑法中已经确立了环境监管失职犯罪,但考察我国环境监管失职犯罪的特点与现状,司法实践情况并不令人感到乐观,预防环境监管失职犯罪任重而道远。当前应积极寻求环境监管失职犯罪的防范之策,加大对此类犯罪的侦查工作,强化司法工作,推进立法完善,强化监督预防机制。如此,将有利于促进人与自然的和谐。

Environmental crime is a serious threat to environmental resources for human survival,so it is necessary to prevent such crimes from happening from the source.Crime of dereliction of duty environmental monitoring is the premise leading to environmental accidents.Although environmental regulation in criminal law has been established,judicial practice is still far from optimism.Examining the characteristics and status of the crime,there is a long way to go.The current regulatory environment should actively seek to prevent this crime,strengthen the investigation of such crimes and administration of justice,promote sound legislation,and improve the supervision and prevention mechanisms,which will help to promote harmony between man and nature.
