摘要
随着时代的变迁,社会经济的高速发展,人们的观念也发生了转变,从对行政权介入私权的绝对排斥到出于某种需要行政权可以适当的介入私权,只是这个介入必须是有界限的,即只有在事实清楚、证据确凿的情况下,依据法律的授权才能够介入私权。但是当社会进入到风险社会之后,这个界限开始变的模糊了,从秩序行政到给付行政再到风险行政,行政权积极的介入私权,甚至基于风险预防的需要,可能在毫无根据的情况下介入,在这种情况下,基于权力自身的扩张性以及人性的弱点,行政权异化现象日渐明显,若不对其加以规制,所带来的后果将是灾难性的。
with the profound social transformation and rapid economic development, the people's attiludes have shifted from re-jection of administrative power's inference in their private rights to the moderate acceptance out of some practical considera tions, provided the interference is within the borderline, i. e. the administrative agencies are empowered to interfere in priva tive rights on the ground of sound facts and solid evidence. However, when we are entering a risk society, the borderline is blurred with order administration changing to supply administration and then to risk administration. Administrative power in terferes actively in private rights, and even groundlessly out of the needs to prevent risks. Under such a circumstance, adminis-trative power, due to the expansion of rights themselves and human weaknesses, is gradually alienated, if not constrained, it will cause disastrous consequences.
