There are positive view and negative view on whether we can gather the foetus organs for transplant or not ;it will cause many ethical and legal problems. If we want to gather the foetus organs, we must set certain con- ditions and criteria. From the point of practice, getting the organs is easy to breed foetus abortions and encourage the commercialization of the organs;medical units will in advance transplant foetus organs, urge women to choose abor- tion method or way, and make the receptors crime phenomenon like the risk of infection in the body. It is necessary for criminal law to regulate reasonably getting, implanting, buying and selling, and disposal of the foetus organs.
