The Dilemma of Punishing Commercial Bribery in E-commerce and Countermeasures

电子商务中商业贿赂犯罪有别于我国刑法中的传统犯罪,现行刑法对其适用存在空白地带,给侦查、审查起诉以及审判活动带来了司法困境,为此我国亟需加大侦查力度,完善刑法规定及刑事诉讼和证据规则,改善电子商务的运营环境,从而有效发挥刑法对电子商务犯罪的规制效用。

Commercial bribery in e-commerce differs from the traditional crimes stipulated in the Criminal Law of China, and the legal vacancy in its application has brought about the judicial plight to the investigation, prosecution and judicial activities. Therefore, we must spare no effort to improve investigation, stipulations in the criminal law, rules of evidence in criminal proceedings, the operating environment of e-commerce, and thus effectively guarantee the criminal law＇s filnction in regulating e-commerce crimes.
