中越边境地区涉外民商事送达司法协助机制构建之探析

由于中越边境地区存在其自身的特殊性,将中越两国间现行的涉外民商事送达协助一般制度适用于该地区存在一定弊端;结合中越边境地区的特点,探索专门适用于该地区的涉外民商事送达协助机制是十分必要的,而且是可行的;该机制的构建主要涉及协助主体的明确、协助程序的设计以及构建路径的选择等方面问题。
