现代商法的公法化与我国民法、商法和经济法调整模式选择

Transforming of Modern Commercial Law to Public Law and Regulation Pattern of Commercial Law, Civil Law and Economic Law in China

以现代商法的公法化为切入点 ,探讨了商法公法化与经济法之间的关系以及我国民法与商法的调整模式 ,指出商法公法化使得商法具有了经济法的某些特征 ,但二者之间的根本界限十分清晰 ;商法公法化进一步拓展了普通私法 (民法 )的调整范围 ,但仍未超越私法的领域 。

The paper studies the relationship between Commercial Law and Economic Law, the regulation pattern of Civil Law and Commercial Law from the viewpoint that modern Commercial Law is transforming to Public Law. It points out that Commercial Law is very different from Economic Law and the relationship between Civil Law and Commercial Law is that of common law and special law.
