“People’s Judicature”and the Modernization of Contemporary Chinese Judicature

人民司法是中国共产党执政的合法性资源,厘清人民司法的理念和实践可提升人们对当代中国司法的理解。在梳理"人民司法"生成的理论渊源和发展的历史轨迹的基础上,从权力的来源、目标和路径三个方面界定"人民司法"的概念。通过人民司法理念与中国传统司法理念、现代司法文化的关系来论证人民司法理念支撑当代中国司法理念和制度现代化改革的重要意义。

＂People＇s judicature＂ is an important legal resource of the governance of Chinese Communist Party after the founding of People＇s Republic of China. To clarify the traditional conception and prac- tice of people＇s judicature can relive the process and mechanism of the legal construction of Chinese Communist Party and improve our understanding of the contemporary Chinese judicature. It is held that people＇s judicature both inherits and breaks through Chinese traditional notion of justice, is pro- foundly related to modern democratic politics, and learns from the modern law and judicature originating from the West.
