摘要
基于对信息资源的垄断性地位,搜索引擎服务提供商承担着保证搜索结果的客观性和公正性的重要义务。随着相关市场规模的扩大,有关搜索引擎的垄断问题已经日益突显。占据市场支配地位的搜索引擎服务提供商对搜索结果进行干预的屏蔽行为是否构成滥用市场支配地位?该屏蔽行为是否可以纳入到反垄断法的范畴?如何运用反垄断法规制搜索引擎服务提供商的市场行为?这些问题都亟须在反垄断法的适用环节进行明确。
With the monopoly of information resources,search engine service providers have the ob-ligations to ensure the objectivity and impartiality of search results.With the expansion of relevant markets,monopoly-related issues of search engines have become increasingly prominent.The follow-ing questions are urgently waiting to be answered in the application of the anti-monopoly law.Wheth-er malicious shielding behaviors made by dominant search engine service providers are abusing the dominant position or not? Whether these behaviors should be taken into the scope of the anti-monopo-ly law or not? What are the workable approaches to regulating these behaviors with the anti-monopoly law?
