A Research on Legislation Problems with the National Security Law of China

国家安全是国家发展和社会稳定的重要前提。出台新的《国家安全法》是加强国家安全工作的迫切需求。对"国家安全"一词的不同解读,决定了《国家安全法》不同的规制范围,明确"国家安全"的外延是制定《国家安全法》的前提,《国家安全法》的立法内容应注意与现行法律规范的衔接,体系设置应立足宏观,着眼全局,体现立法的原则性、概括性。

National security is the important premise of the national development and social stability. The new Na- tional Security Law （NSL） is much needed for strengthening the state security. Different interpretation of the term national security determines the different regulation range of the NSL. Clarifying the extension of national security is the premise of making the NSL. The content of NSL should be connected with current laws. Its framework should be based on the macro environment in an all - round manner, and then reflect the principle and generality of legisla- tion.
