诈骗罪的犯罪对象应当包括财物和财产性利益,由此带来的问题是当财产利益作为诈骗罪对象时如何正确判断犯罪既遂。从损失说角度出发,当诈骗犯罪的对象为财产性利益,行为人直接占有财物与被害人受到财产损失之间存在时间差时,诈骗既遂的时间应当是被害人受到损失之时。

The criminal object of crime of swindling includes property and the interest of property.Consequently, when property interest is taken as an object of fraud, how to properly judge the accomplishment of a crime. Viewed from the angle of property loss, when the object of fraud is a property interest, there is a mistiming between offenders＇ actual control of property and damage to victims. In this case,the time when the victim suffers losses should be regarded as the time of accomplishment of fraud.
