摘要
劳资关系是职业体育的核心问题,职业体育运动员工作合同在职业体育劳资法律关系中起着重要的作用。美国的职业体育劳资法律制度比较成熟,职业体育运动员工作合同的签订需要遵守一定的程序,合同的内容范围广泛,包括保留条款、伤病条款、技能条款、运动员交易条款、奖金条款、保证服务期满条款等。对于因合同而产生的纠纷,设置有较为完善的纠纷解决机制。中国职业体育劳资结构尚不完善,职业体育运动员工作合同内容不健全,应该加速推进职业体育劳资制度的法制化。
Labor capital relation is the core of the professional sports. The Collective Bargaining Contract in professional sports plays an important role in the professional sports labor capital legal relation. There is a mature professional sports labor legal system in the United States. It needs to follow certain procedures to reach the Collective Bargaining Contract, which includesmandatory subjects and permissive subjects. Mandatory subjects include reserve clause, injury clause, trading clause, bonus clause, and guarantee service expiry term etc. There is comparatively perfect dispute system. The labor legal relationship and related legal system are not perfect in professional sports in China and the collective bargaining in professional sports is needed.
