摘要
《劳动合同法》从2006年3月发布征求意见稿就引发了社会大讨论,这部法律的审议、颁布、实施和修订过程一直伴随着纷繁复杂的质疑和争鸣,这在一定程度上消解了对《劳动合同法》本身价值的认识。经济社会中,合理构建法律可以使私人协商失败造成的损害最小化,《劳动合同法》正是致力于改变劳动者和企业的行为空间,在生产领域促效率,在分配领域促公平。《劳动合同法》以构建和发展和谐稳定的劳动关系为宗旨,力图使劳动者和企业形成利益共同体、事业共同体、命运共同体和使命共同体,这才是这部法律的真正价值所在。在制度设计上,《劳动合同法》通过构建工作场所用工类型体系、指出工作场所劳动关系管理的突破口、打造中国特色的劳动关系治理体系,形成了特色鲜明的制度创新。新时期构建和谐劳动关系,应在企业民主管理实质化、优化企业发展环境等方面进一步完善,同时还应针对经济新常态下工作行为的变化创新监管理念。
The draft for comment of Law of The People's Republic of China On Employment Contracts( hereinafter referred to as Labor Contract Law) was released in March,2006. Great discussions across the whole society emerged by the release,and they have been continuing over the process of the law's reviewing,issuing,implementing and revising. Suspicions and controversy thus would block people's perception to the law itself to some extent. In the economic society,construct the legal system would neutralize the damage caused by failure of private negotiations. It is Labor contract law that aims at optimize the behaviors of employers and employees,which facilitates efficiency in production and fairness in distribution. The law stands for creating and developing harmonious labor relations,which brings employers and employees into a community of interest,a community of career,a community of fate and a community of mission. This is the very value of the law. Also,in terms of system design,it is characteristic of Labor Contract Law to accomplish system innovation,by constructing types of work in workplace,pointing out the gap of labor relations management,crafting the system of labor relations governance with Chinese characteristics. In the new era,building harmonious labor relations should improve in aspects as implementing democratic management and optimizing developing environment for enterprises. Meanwhile,the law should innovate the concept of regulation to deal with changes of work behaviors with "the new normal".
