“人情”社会的现实与“法治文化”的出路——从构建公民参与性法律机制谈起

The "Human-Relationship" Society and the "Culture of Rule of Law" :From the Construction of Citizens' Participation in Legal Mechanism

我国现阶段依然是一个人情社会,在历史的文化传承之中形成了具有中国特色的现实。在当前建设法治文化的基本背景下,对于人情需要加以更多的重视。中国国情具有丰富内容,人情社会是我国当前不容忽视的现实,也是法治中国建设的基础。人情也存在妥适与非妥适之分。妥适的人情对于法治文化建设存在着促进作用,相反则会起到阻碍作用。进一步分析"人情"与"法治文化"二者之间的关系,有助于界定二者之勾连,找寻法治文化建设的出路。在公民参与的法律机制下,能够更好地实现二者之间的相互促进,为最终实现法治中国建设提供助益。

Currently, China is still in a human-relationship society, forming the reality of Chinese characteristics in the history of cultural heritage. Under the background of the construction of rule of law,it is necessary to pay more attention to human-relationship. China＇s conditions are complex, and human-relationship society is China＇s current reality, which can not be ignored. Also, it is the basis of rule of law in China. There are appropriate human-relationships and non-appropriate human-relationships. The former can promote cultural construction of rule of law, and the latter may harm it. A further analysis of the relationships between ＂human relationship＂ and ＂culture of rule of law＂ is helpful to defining the two parties,and finding the ways of construction of the rule of law culture. The legal mechanism of citizens＇ participation can promote their integration.
