摘要
公办学校正在探索一条能有效改造传统公办学校体制、重构国家与教育关系的改革新路。市场作为推进教育制度改革的一种动力正在改造公办学校体制的运行方式,政府与学校二者的关系正在向政府、学校、市场三者之间的关系转变,公办学校的定位问题就是由此产生的。如何理解市场经济条件下公办学校的公益性质则是公办学校定位的一个关键性问题。公办学校应是由国家设立,为不特定多数人服务,以培养人才、创新和保存知识为目的,面向社会自主办学的功能性社会组织。从机构性质看,公办学校应是一种非政府和非企业的社会组织;从社会功能看,应是国家以培养社会所需人才、开展学术研究为目的而举办的、由公共财政经费维持的社会组织;从其与政府的关系看,是具有独立管理机构的组织体,而不是行政机关的内部单位和附属机构;从法律地位看,作为独立办学的法人机构,公办学校的办学权利是一种复合型权利,其中既有通过政府的公务分权获得的公权力,也有作为独立法人所具有的法人权利。公办学校作为法人依法享有的民事权利不应当损害公办学校的公益性质。
The aim of public school reform is to explore a new way that can effectively improve the traditional public school system, and reconstruct the relationship between the state and education. As a strong player to promote the reform of the education system, the market is transforming the operational mode of the public school system, complicating the relationship between government and school. The orientation of public schools is the result of this problem, and thus how to understand the public nature of public school under the condition of market economy has become a key issue of public school orientation. Public schools should be set up and sustained by the government for the majority of people, for training talents, boosting innovation and preservation of knowledge, and should be society- oriented and autonomous in management. In terms of institution, public schools should be non - governmental non - entrepreneurial social organizations. In terms of social function, public schools should be organized by the state with public financial provisions to cultivate the talents needed by the society and to carry out academic research. In terms of government - school relationship, public schools should be an independent institution, rather than internal to and affiliated with administrative authorities. In status, public schools should be a legal entity independently run by the schools, showcasing a compound right of government authorization and an independent legal person. As a legal entity, public schools enjoy civil rights, but should not damage public welfare.
