摘要
我国《城镇国有土地使用权出让和转让暂行条例》、《城市房地产管理法》、《土地管理法》和《物权法》已经确立了住宅建设用地使用权续期规则,但该规则过于原则,操作性不强,导致理论与实践上均存在诸多问题。为了保障公民最基本的生存权,同时为了均衡分配土地资源,缩小贫富差距,续期应当以无偿为原则,有偿为例外;续期的期限应当以建筑物的安全使用年限作为续期的上限,且不应限制续期的次数。
The rule of renewal of the right to use residential construction land has been enacted by Interim Regulations of the People's Republic of China Concerning the Assignment and Transfer of the Right to the Use of the State-owned Land in the Urban Areas,Urban Real Estate Administration Law,Land Administration Law,Real Right Law,but the rule is too vague and general,causing plenty of problems of doctrine and practice. This study proposes that renewal of the right to use residential construction land should be free in general,and be paid under particular condition,ensuring citizens' fundamental rights,equally distributing land resource and narrowing down the gap between the rich and the poor. Duration of extension of the right to use residential construction land should not be more than lifespan of the construction,and the times of renewal should not be limited.
