跨境电子商务法律借鉴与风险防范研究

A Study on the Legal References and Risk Prevention of Cross-border E-commerce

法律问题随着跨境电子商务的发展而日益凸显,且无法匹配跨境电子商务的需要,在我国表现得更加突出。我国跨境电子商务法律体系缺失,现有的传统领域法律尚不适用,电子商务方面法律也有待建立与完善。与欧盟、美国、亚太等国家相比,我国跨境电子商务法律体系尚不健全,远落后于其他国家。不仅如此,我国在跨境电商平台责任、消费者权益保护、跨境物流、跨境支付、通关与商检、税收、信息安全、知识产权等方面的法律也有待进一步建立与完善,这些都成为后续我国跨境电子商务法律体系建设的重点。

The legal issues have become increasingly prominent with the development of cross-border e-commerce.In China,the problem is even more obvious.The legal system of cross-border e-commerce in China absents,the present laws of traditional fields do not adapt,laws for crossborder e-commerce waiting to be established and perfected.Compared with the European Union,the United States,Asia Pacific and other countries,China＇s cross-border e-commerce law system is not perfect,and is far behind the other countries.In addition,China＇s law system in the cross-border e-commerce platform responsibility,consumer protection,cross-border logistics,cross-border payments,customs clearance and commodity inspection,taxation,information security,intellectual property and other aspects also needs to further established and perfected.They will be the following-up focus to the construction of cross-border e-commerce law system in China.
