Practice and Analysis of Joint Participation of the Investor and the Contractor in the PPP Procurement Project

在基础设施和公共服务领域大力推行的PPP模式,随着政府采购行为的法律法规不断涌现已逐渐规范。作为一家国有大型施工企业的经营人员,多次参与PPP项目的采购活动,对PPP模式一直在实践与分析。文章认为PPP项目采购活动是招标投标活动的扩展,同时说明PPP项目的实施主体、采购方式及评审方式区别,通过参与的案例,从承包人的角度出发,关于PPP项目采购中的承包人的招选问题上,分析大致为法律、风险层面促成,直接招选有资质的承包人参与PPP项目同时具备很多优势。

With increasing laws and regulations on government procurement activities, the PPP mode promoted vigorously in the field of infrastructure and public service has been standardized gradually.As an operator of large-scale state-owned construction enterprise, the author has participated in the procurement activities of PPP projects for many times and practiced and analyzed the PPP mode all the time.In this paper, the author points out that the PPP project procurement activities were the expansion of the bidding; the differences of the implementation subject, procurement method and review mode of PPP projects were also described.The author analyzed the selection of the procurement contractors of the PPP projects from the perspective of the contractor with relevant cases.Considering relevant laws and risks , qualified contractors were selected directly to participate in the PPP projects, and they had many advantages at the same time.
