Open Development and International Law:Risks and Countermeasures

采取疏离国际法的策略去参与全球化、推进开放发展,可能给中国带来的是认同风险和声誉风险;反之,如果采用借助国际法的方式,遇到的主要风险是观点风险和能力风险。认同风险是国家与民众对于本国在国际社会中的行为方式和身份的认同缺失;声誉风险是国家在世界上采取行动所积累的信用降低。这些是对国家发展至关重要的核心决定因素,国家无法克服这两种风险转化为现实威胁的严重后果。所以,这种风险是不可解的,必须尽最大努力避免此种风险,改为借助国际法的策略进行发展。观念风险主要是国家开放发展过程中的各种国际法无用论或虚无论观念;能力风险则主要是国家所存在的体系认知、立法技术和专业队伍的差距。如果采用借助国际法的策略开放发展,应对两种风险的主要决定因素来自国家内部,因而是可以克服和改变的。通过自身的认真钻研、锐意创新,就能够达到充分利用国际法、改进原有国际法体系的目标,从而为中国及世界各国寻求互利共赢的发展道路。

When China participates in globalization and promotes open development in a way of alienation of international law, we will have to face with risks of identification and reputation.. On the contrary, when Chi- na adopts the open development strategy in light of international law, the main risk encountered will be notion and capacity. The risk of identification is whether a state can be recognized and accepted in the international community; the risk of reputation is whether a state may accumulate credit in the world. These are core deter- minants of vital importance for a state in development, and when these two risks translate into real threats, the serious consequences cannot be overcomed.. Therefore, these risks are not solvable and every effort must be made to avoid such risks and to develop in the way of international law. The risk of notion is mainly various views of ignoring and undermining international law in the process of state development ; the risk of capacity is mainly the weakness in knowledge and operation ability in the professional team.. If the strategy of open devel- opment in the way of international law is adopted, the main determinants of the two risks can therefore be over- eomed and the capacity building will be established.. With clear and serious approach of study and innovation, China can achieve the goal of fully using international law as well as improving existing international legal sys- tem, so as to seek a path of mutual benefit and win - win development.
