摘要
以最高人民法院公布的指导性案例的1号"跳单"案件为例,梳理二审法院在二手房居间交易纠纷裁判过程中的三个争议焦点,分析房屋居间合同中"跳单"条款的法律效力和"跳单"行为的法律后果,提出对防范"跳单"现象而建立居间活动必要费用阶段性收取、规范二手房居间交易合同范本的机制性构想。
NO. 1 "Jumping broke" is a case of the first batch of four guiding cases announced by the Supreme People's Court in December 2011. Three issues about the second-hand housing intermediary trade disputes are focused in the judgment of the court of second instance. The legal effect and consequence of the "Jumping broker" clause in the brokerage contract are analyzed. In addition, for preventing the phenomenon of"jumping brokers", a conception is put forward in order to establish a mechanism that collecting necessary expenses by phasing and provide contract template of second-hand housing transaction.
