我国现行新能源汽车财政补贴政策有违市场公平竞争机制,违反《反垄断法》,导致"骗补行为"频发。为了完善我国新能源汽车财政补贴的法律规制,应当对现行政策进行公平竞争审查,建立、修改新能源汽车的财政补贴的基本立法,制定相应法规规章及发挥监督主体的监督作用。

China＇s current financial subsidy policy of new energy vehicles is contrary to the market fair competition mechanism, in violation of the anti-monopoly law, leading to ＂cheat up behavior＂. In order to improve the legal regulation of financial subsidies for new energy vehicles in China, We should carry out the fair competition review of existing policies, establish the basic legislation, modify the new energy vehicles subsidy, formulate corresponding regulations and supervision function of supervision subject.
