互联网技术深刻改变了传统市场结构,也颠覆了传统市场治理模式,催生出以平台企业为主导的网上交易市场治理新模式,对政府威权治理形成有益补充或局部替代。平台企业通过复杂的规则创造,以其市场和技术权力,在知识产权保护、契约执行和公共物品供给方面进行了新的机制构建,形成强制性第三方实施机制,对市场交易中的机会主义行为进行惩罚,从而实现了网上市场的有效治理。由于平台企业具有市场交易主体和市场裁决者的双重身份,其行为存在天然局限,一个稳定的、非寻租的"守夜人"政府在网上市场治理方面依然不可或缺,需要加快构建政府和平台企业相互制衡、相互作用的网上市场协同治理结构。

Abstract：Internet technology has profoundly changed the traditional market structure and subverted the tradi- tional market governance model. A new online transaction market governance model, which is dominated by platform enterprises, has come into being. This constitutes a useful or partial substitute for the government＇s au- thoritarian governance. Because platform enterprises are both market transaction entities and market arbiters, there is a natural limitation of their behavior, so stable, non - rent - seeking ＂night watchman＂ governance in the online market is still indispensable. We need to speed up the establishment of an online market collaborative governance structure, which ensures mutual check and balance between the government and platform enterprises.
