中国经济存在严重的产业结构失衡、产能过剩和大量僵尸企业的问题,这些问题的产生与长期执行产业政策具有相关关系和因果关系。反思产业政策的制度演变,厘清产业政策、市场机制、市场失灵与政府监管的边界,通过法律制度体系,建构一个市场自治、法院诉讼、行业自律、政府监管、国有企业的执法分析框架,比较不同机制执法的公正与效率。对于中国经济转型与维护市场经济秩序,执法范式转变和监管制度调整已经刻不容缓。

China＇ s economy has suffered from serious problems of unbalanced industrial structure, overca- pacity and a large number of zombie enterprises, which are correlated to and caused by the implementation of industrial policies. It is time to rethink the evolution of the industrial policy and clarify the boundaries among industrial policies, market mechanisms, market failures and government regulation. An analytical legal frame- work comprising of market autonomy, court litigation, industrial self - regulation, government regulation and state - owned enterprises, should be established to compare the justice and efficiency of different models of law enforcement. It is critical to adjust the paradigm of law enforcement and regulation, to facilitate the restructuring of China＇ s economy and maintain the order of market economy.
