中国海外投资的环境保护问题——基于投资法维度的考察

Environmental Protection Related to Chinese Overseas Investments:An Investigation from the Dimension of Investment Law

中国海外投资在投资地或东道国面临的各类环境问题及风险日益突出,影响到中国海外投资的可持续发展及中国国家利益的实现。就投资法的角度而言,中国海外投资的环境保护问题可以从两方面来考察:一方面,保护中国海外投资地环境的东道国和母国中国的国内投资法体系,其最近的发展从各个方面加强了对海外投资地或东道国环境的保护。另一方面,国际投资条约的环境条款和相关国际投资仲裁案件越来越注重对东道国环境公共利益的保护,中国也展开了与此相应的国际投资协定实践。东道国与母国中国的国内投资法及与中国有关的国际投资协定,作为一个法律体系切实地共同发挥作用,能够使中国海外投资环境保护问题得到更好的解决。

Different types of environmental problems and risks faced by Chinese overseas investments are increasingly striking, thus leading to adverse effect on their sustainable development and the realization of China＇ s national interests. From the perspective of investment law, environmental protection related to Chinese overseas investments can be explored from two aspects. On the one hand, there exist the legal systems of domestic investment laws of both the host states and China as the home state on environmental protection related to Chinese overseas investments, and the common recent devel- opment of these laws is to strengthen the protection of environmental public interests of the host states from every aspect and dimension. On the other hand, in the context of increasing importance attached to the environmental protection of the host states embodied in environmental clauses in international investment treaties and relevant international investment arbitrations, China＇s corresponding practices in international investment agreements are implemented. When domestic investment laws and China - related investment agreements faithfully and jointly function as one integral legal system, they will be able to play more positive role in environmental protection related to Chinese overseas investments.
