The Study on Some Problems of Units' Confessing Crimes

单位自首是单位在单位犯罪后,由能够代表单位意志的人基于单位的自首意志,以单位名义自动投案,如实供述单位的罪行。单位自首的构成要件应该包括单位自首的实施者能够代表单位自首的整体意志、以单位自首的名义、自动投案、如实供述四个构成要件。单位自首及单位内部自然人自首的认定可分为三种情形:单位成立自首,单位成员也成立自首;单位成立自首,单位成员不成立自首;单位不成立自首,单位内部人员成立自首。

At present,scholars in the field of criminal law of our country have different views on whether the units constitute units' confessing crimes and the elements.In the paper,the author affirms that the units constitute units' confessing crimes and units' confessing crimes include four elements.The author discusses the four elements identified in practice in detail.The last part discusses the problems and solutions in identification of units' confessing crimes.
