摘要
在界定网络主播劳动关系的过程中,主要存在直播业工作性质界定不清和现行劳动标准无法适用的问题,需要正确认知劳动关系,确立劳动关系保护制度,完善纠纷救济法律制度,改革现有用工模式,从而确立认定网络主播劳动关系的新思路。
The rapid development of the Internet age has promoted the high degree of innovation of the Internet industry.In recent years,the interactive platform based on live network has become a hot spot in society.China's legal regulation of the Internet is not yet mature,so many problems arising from the Internet have caused many disputes in practice.In the process of defining the labor relations of network anchors,there are some difficulties and problems,such as unclear definition of the nature of live broadcast industry and the inability to apply the current labor standards.Therefore,the correct understanding of labor relations,the establishment of labor relations protection system,improve the legal system of dispute relief and bold innovation and reform of the existing employment model can become a new way to identify the relations of network host labor.
