美国法学院的律师养成教育及对我国的启示

美国现代法学教育的特色就是律师养成教育,其提倡的"案例教学法"以培养学生律师式思考方式为目标,同时辅之以"苏格拉底教学法",教导学生成为律师的必要技巧。我国应借鉴美国法学教育之经验,探索中国特色法学教育新模式,在课堂中引入境遇式实验教学法和"席明纳"教学法,注重法科学生的职业伦理教育,培养具有社会正义感和责任感的法律人。

The characteristic of modern legal education in the United States is the education of cultivating the lawyers.The case teaching method teaches the students to think"like a lawyer".And the Socrates teaching method teaches the students to grasp the necessary skills of being a lawyer.We may learn from the experience of legal education in the United States and explore the new mode of law education with Chinese characteristics.The situation type experiment teaching method and the seminar teaching method must be adopted in the classroom.We should pay attention to the professional ethics education of the law students.Cultivating the legal people with the sense of social justice and responsibility is the final aimof the law schools.
