中国特色自由贸易港离岸金融的创新路径与立法保障——以海南自由贸易港离岸金融创新为视角

The Innovation Path and Legislative Guarantee of the Offshore Finance Based on Hainan's Free Trade Ports with Chinese Characteristics

离岸金融业务是海南自由贸易港建设不可或缺的一环,离岸金融创新是海南自由贸易港金融开放创新最重要也是最艰巨的改革任务。离岸金融业务主要包含离岸资金池、离岸金融中介服务、离岸金融风险管理三大业务。目前海南金融业整体规模小、市场化和创新程度低、金融人才不足且缺乏中央配套政策支撑。未来海南应当以人民币国际化为中心打造人民币离岸资产交易中心、建设离岸金融账户、打造结算型金融中心。海南离岸金融创新必须遵循维护金融秩序与稳定、适度监管与创新监管、注重金融消费者利益保护、加强跨国监管合作与协调等四大法律保障原则。创新离岸金融业务监管模式,构建离岸金融创新审慎监管框架,降低市场准入门槛,强化事中事后监管,将RegTech运用到离岸金融创新监管中。

Offshore financial business is an indispensable part of Hainan s free trade port construction.Offshore financial innovation is the most important and arduous reform task for Hainan Free Trade Port s financial open innovation.Offshore financial business mainly includes three major businesses:offshore fund pool,offshore financial intermediary services and offshore financial risk management.At present,Hainan s financial industry is small in scale,low in levels of marketization and innovation,lack of financial talents and lack of support from central supporting policies.Hainan is expected to build the RMB offshore asset trading center,build offshore financial accounts,and build a settlement-type financial center with the internalization of the RMB as the center.Hainan s offshore financial innovation must follow the four legal guarantee principles of maintaining financial order and stability,appropriate supervision and innovation supervision,paying attention to the protection of financial consumer interests,and strengthening transnational regulatory cooperation and coordination.Apart from these measures,Hainan is also supposed to innovate the offshore financial business supervision model,construct a prudential supervision framework for offshore financial innovation,reduce market entry barriers,strengthen post-event supervision,and apply RegTech to offshore financial innovation supervision.
