摘要
建设工程中承包人项目经理角色和权利的来源,有承包人“委托”、或“任命”等不同的观点,对于是否应设置项目经理的“授权范围”,相关合同范本表述也不一致。本文从项目经理是承包人员工的角度出发,认为项目经理是经过承包人“任命”(或指派)获得“代理权”,该代理属于“职务代理”的范畴。按照建设工程合同性质理解,结合FIDIC条款、2012版“标准招标文件”等材料,我们认为不应对项目经理限定所谓的“授权范围”。
The source of the role and rights of the contractor's project manager in the construction project has different opinions such as“ consignment” or“ appointment” of the contractor. The“ professional scope” of the project manager should be set, and the relevant contract model expressions are also inconsistent. From the perspective of the project manager as a contractor employee, this paper considers that the project manager is“ appointed”(or assigned) by the contractor to obtain“ agent rights”, and the agent belongs to the category of“ service agent”. According to the understanding of the nature of the construction project contract, combined with FIDIC terms, the 2012 version of the "standard bidding documents" and other materials, we believe that the so-called "authorization scope" should not be limited by the project manager.
