摘要 现今网络餐饮繁荣发展的同时伴随着层出不穷的食品安全事故,食品安全监管问题也受到国家和社会的强烈关注。我国网络餐饮食品安全监管立法上存在监管机构职能模糊、罚款数额设置过低的缺陷。在实践中遭遇到监管部门执法压力增加、网络平台提供者履行义务不彻底、社会监督作用失灵的困境。基于此,可以通过列出“权责清单”,加大处罚力度,建立食品安全风险信息中心和信息披露制度,线上线下监管双管齐下,督促网络平台自检自查,构建社会共治格局等措施来解决,推动网络餐饮食品安全监管工作不断进步。 Nowadays,the prosperity and development of online catering is accompanied by endless food safety accidents,and the problem of food safety supervision has also attracted the strong attention of the state and society. There are some defects in the legislation of food safety supervision of online catering in our country,such as the vague function of the supervisory authority,and the low amount of fines. In practice,it encounters the dilemma of increasing law enforcement pressure from regulatory authorities,incomplete fulfillment of obligations by network platform providers,and the failure of social supervision function. Based on this,some measures can promote the continuous progress of network catering,such as listing the “rights and responsibilities list”,increasing the punishment,establishing a food safety risk information center and information disclosure system,online and offline supervision,supervising and promoting the self-inspection of the network platform,and building social co-governance pattern.
