2019年版外商投资准入负面清单对中国油气行业的影响

2019年3月15日《中华人民共和国外商投资法》出台,明确了对外商投资实行准入前国民待遇加负面清单的管理制度.2019年版外商投资准入负面清单取消外资进入油气勘探开发和城市燃气领域的限制性规定,标志着中国油气产业链全面对外开放.中国油气勘探开发领域配套法规政策尚未调整完毕,城市燃气领域已实现充分竞争,使得新版负面清单短期内不会对油气行业及市场主体产生太大影响,但从长期来看影响将逐渐显现.三大石油公司在产业链各环节将面临更加激烈的市场竞争,民营企业将面临优胜劣汰.在外资独立进入油气勘探开发领域及城市燃气领域之前,中国相关法律法规尚需调整和完善;之后需要加强管理,以保证矿权的高效利用以及城市燃气市场的规范有序.

Issued on March 15, 2019, the Foreign Investment Law introduced the pre-entry national treatment and the negative list for the admission of foreign investment. Special Administrative Measures for foreign investment access(negative list)(2019 Edition) lifts the limit on the foreign investment entry into the oil and gas exploration and development field and the urban gas utilization field, which marks the overall openness of Chinese oil and gas industry chain. Since the supporting laws and regulations have not been adjusted completely, and the urban gas utilization field is under fully competition, which make the newly negative list not have a big impact in the short term, but the impact will become apparent gradually in the long run. Three major oil companies will face more fierce competition in every aspect in the industry chain and private companies will meet selecting the superior and eliminating the inferior. Before the foreign investment can independently enter into the exploration &development field and the urban gas utilization field, the laws and regulations need to be modified;then the government need to enhance management in order to guarantee efficiently utilizing the mining rights and orderly regulating urban gas market.
