宋代法律价值冲突的整合——以“亲邻法”为例

Integration of Legal Value Conflicts in the Song Dynasty:A Perspective from the “Law of Kinship and Neighborhood”

宋代是开启中国近世社会变革和转型的时代。宋代"亲邻法"规则不断演进的过程,展现了社会变革带来的法的秩序价值与自由价值、效率价值、公平价值之间的冲突,以及中华"和合"文化、"情理法"一体的司法理念对法的价值之间张力的调适和整合。宋代"亲邻法"规范的变迁既推进了田宅交易自由和效率,又维系了传统社会的家族伦理秩序,表现出中华传统文化强大的聚合力。这一法律制度变迁蕴涵的法的价值理论、昭示的"世易时移、变法宜矣"的法律哲理,对变革中的当代中国具有史鉴价值。

Song Dynasty started the era of reform and transformation in modern China. The "law of kinship and neighborhood"in Song Dynasty from writing to evolving process shows the conflict between the order value of law and the value of freedom,efficiency and fairness brought about by social change,and the relaxation and integration of the tension between the Chinese "Harmony "culture and the judicial idea of"integration of human feelings,reason and law"to the values of law. In Song Dynasty,the change of the norm of "law of kinship and neighborhood"promoted the freedom and efficiency of trade in farmland and houses,maintained the family ethical order of traditional society,and showed the strong cohesive force of Chinese traditional culture. The value theory of law embodied in the change of legal system and the legal philosophy of"changing the world and changing the law properly"are of historic value to contemporary China in the process of reform.
