浅谈专利诉讼分析对于提高专利分析准确性的重要意义

The Significance of Patent Litigation Analysis on Improving the Accuracy of Patent Analysis

经济全球化进程的加快,提升了知识产权在社会经济发展中的战略地位。企业也越来越重视专利分析及风险预警,以制定企业竞争策略,避免可能的知识产权纠纷。然而,传统的专利分析对专利诉讼分析重视尚显不足。本文从中国电池工业协会诉讼外国公司一项专利无效的案件出发,指出缺少专利诉讼分析的专利分析结论所存在的缺陷,并且以磷酸铁锂的专利诉讼实例深入分析如何通过专利诉讼分析提高专利分析的准确性。

With the acceleration of economic globalization,the strategic position of intellectual property in social and economic development is enhanced. Enterprises also pay more and more attention to patent analysis and risk warning,to develop competitive strategy to avoid possible intellectual property disputes. However,the traditional patent analysis is insufficient to analyze patent litigation. In this paper,the authors point out that there are defects in the patent analysis conclusion which lacks patent litigation analysis in a patent litigation case. What is more,another case is provided to prove that it is useful to improve the accuracy of patent analysis through patent litigation analysis.
