犯罪主体的网络化演变动向与立法修正脉络

Evolution and Modification of the Network Subject in Cyber Crimes

传统犯罪主体的网络化演变已显现出一定的规模性,自然人与法人两大基本主体的网络化迹象明显,网络平台、智能主体等新兴主体类型相继出现。传统犯罪主体的立法与理论明显滞后于网络主体的代际特征,产生了一系列衔接难题。虽然《网络安全法》等法律法规与刑法修正案均涉及网络犯罪主体,但仍无法提供全面有效的规范供给。这既见证了新型网络犯罪主体的胎变,也揭示了传统犯罪主体范畴无法阐释与包容新型网络主体特质的理论落差。应当积极推动犯罪主体理论的网络化转型,通过立法积极修正并确认网络犯罪主体的类型,完善相应的制裁体系等配套制度,协同网络刑法学理论变革的发展步伐。

The network evolution of the traditional criminal subject has been manifested both in the scale of the natural person and its accomplice form such as the organization,the gathering,and the legal person(unit).And“intelligent subject”and network platform and other emerging subject types have emerged.The traditional legislation and theory of criminal subject obviously lags behind the intergenerational characteristics of the network subject,thus makes a series of docking problems.Although the Internet Security Law and other laws and regulations and criminal law amendments all involves in the main body of the subject of cybercrime,comprehensive and effective supply of norms still can’t be provided.The change not only witness the new offspring of the main types of cybercrime,but also reveal that the traditional criminal subject can’t explain the new characteristics of the network gap.It is necessary to actively promote the network transformation of the criminal subject revise and confirm the types of the main body of cybercrime through legislation,advance the matching system such as the corresponding sanctions system and coordinate the development of the theory of network criminal law.
