互联网环境下协议管辖适用的困境与建议--以涉外民事诉讼为视角

The Dilemma and Suggestions of the Application of Agreement Jurisdiction in the Internet Environment:From the Perspective of Foreign-Related Iitigation

信息时代为我们的生活提供了极大的便利,促进了国际商务贸易活动的频繁,但同时也使网上纠纷日益增加。传统管辖规则在网络空间的适用中遇到了困难,然而协议管辖却给网上纠纷的解决带来了契机。运用协议管辖解决网上纠纷案件的管辖难题,更能体现意思自治原则,也更能实现诉讼公平。然而,协议管辖虽凭借自己的优势解决了网上纠纷中一些管辖权难以确定的难题,但是在具体的适用过程中,却面临着一些困难。文章最后针对这些困境,提出了一些具体的建议。

The information age provides great convenience for our life, promotes the international business trade activity frequently,and also makes online disputes increase at the same time. Traditional jurisdiction rules have encountered difficulties in the application of cyberspace, but the protocol jurisdictionhas brought opportunities for the settlement of online disputes. Resolving the jurisdictional problems of online disputes by agreement jurisdiction can better embody the principle of autonomy of will and realize the fairness of litigation.Although the agreement jurisdiction has solved some problems of jurisdiction in online disputes due to its own advantages, it is also facing difficultiesin the specific application process. Finally, the paper puts forward some suggestions for these difficulties.
