On the Value of Treating Pandemic by Law

坚持依法治疫,是保障新冠肺炎疫情有效防治的必由之路,其中重视法的价值引领和保障作用的发挥意义重大:可通过法的价值功能,指引法的制定,保障法的实施,防止法的失效,校正法的扭曲,推动法的演进,具体而言,依法治疫需要着重把握和表现的价值包括秩序、安全、自由、平等、正义和效益等内容;而其多重价值的共存,将产生价值间隙甚至价值冲突,故在处理法的这些价值冲突时,需要遵循一定的原则,并以疫情防治的特殊性来凸显安全价值的中心地位。

Adhering to treating pandemic by law is the only way to ensure the effective prevention and treatment of COVID-19 pandemic, and it is of great significance to attach importance to the value guidance and guarantee function of laws. The value function of law can guide law formulation, guarantee law implementation, prevent law failure, correct law distortion, and promote the evolution of law. To be specific, the value of treating pandemic by law should be emphasized, including order, safety, freedom, equality, justice and efficiency. However, the coexistence of multiple values will lead to value gap and even value conflict. Therefore, certain principles should be followed in dealing with these value conflicts, and the centrality of safety value should be highlighted by the particularity of pandemic prevention and treatment.
