摘要
"一带一路"倡议提出后,在促进沿线经济体发展的同时也增多了国际仲裁纠纷。为应对高昂的国际仲裁费用,第三方资助国际仲裁制度存在很大适用空间,但也给公正仲裁带来新挑战。在此背景下,对第三方资助协议进行披露就成为应对挑战的主要手段且具备正当性。新加坡和中国香港的立法及国际仲裁机构发布的规则,都是第三方资助国际仲裁之披露规则建设的重要参考。我国为完善第三方资助国际仲裁之披露规则,应从制定仲裁规则和制定法律法规两条路径出发,并从披露的主体、对象、内容和时间四个方面进行具体构建。此外,还可考虑倡导构建"一带一路"国际仲裁合作联盟。
After"The Belt and Road"initiative was put forward,it not only promotes the economic development along the line,but also increases the number of international arbitration disputes.In order to cope with the high cost of international arbitration,the Third-party Funding system is often used,but it also brings new challenges to ensure the impartiality of arbitration.In this context,disclosure of the Third-party Funding agreements is justified as the main means to meet challenges.The legislation of Singapore and Hong Kong,as well as the rules issued by international arbitration institutions,are important references for the construction of the disclosure rules of Third-party Funding in international arbitration.In order to improve the disclosure rules of Third-party Funding in international arbitration,China could start from two paths:formulating arbitration rules and formulating laws,and making concrete construction from the subject,object,content and time of disclosure.In addition,China can also consider advocating the establishment of the international arbitration cooperation alliance of"The Belt and Road Initiative".
