我国地方政府疫情防控行为的合法性风险反思--以地方“授权决定”为切入点 被引量:11

A Reflection on the Legitimacy Risk to Epidemic Prevention and Control Behavior of China’s Local Government: from Local “Authorization Decision” as a Starting Point

摘要 疫情防控的突发性容易引起政府行为的非常规性,但合法性是地方国家权力机关及其执行机关在实施相应的国家行为时必须坚持的根本标准。各省级人大常委会通过的授权政府采取临时性应急管理措施的决定成为地方疫情防控的重要依据,但从授权行为种类及其权限、被授权主体、征用补偿措施采取的程序等方面可以观察其合法性风险。对一些具有突破性的授权规定,也可以进一步考量对其合法性风险的减除思路:优化地方授权决定的立法理念、注意制定依据和"不抵触"与"不违背"原则的适用、区别细化授权决定的具体内容和模式,以及合理确定"授权决定"生效时间规定。 Although the emergency of epidemic prevention and control is likely to lead to government’s unconventional epidemic prevention and control behavior, however, legitimacy has become the fundamental criterion as a lesson that must be learnt from for local organs of state power and their executive organs in their implementation of corresponding state act. The decision that authorizes government to take temporary emergency management measures adopted by each of the standing committee of provincial people’s congress has become an important basis for local epidemic prevention and control, but the legitimacy risk can be observed from aspects, such as types of the act of authorization and its limits, the authorized body, and procedures of compensation measures for expropriation. For some of the groundbreaking authorization stipulations, it can also be further considered to reduce the legitimacy risk: to integrate and optimize the legislative idea of local authorization decision, to note the basis for policy making and the application of the"no contravention"principle and the"no violation"principle, to differentiate and refine specifics and patterns of the authorization decision, and to reasonably determine the effective time of the authorization decision.
