社区治理法治化的推进路径

Way to promote legalization of community governance

在推进法治国家建设的过程中,社区治理的重要性日益凸显。国家治理能力和治理水平现代化,旨在形成“国家治理社会治理社区治理”的一体化体系,将社区治理纳入国家治理体系范畴,有助于提高社区治理的定位并保持其与国家治理水平的同步发展。国家治理实质就是地方治理,地方治理则体现为社区治理。社区治理是国家治理在基层生动、具体的反映,必须专注于提高社区治理能力和现代化水平,具体路径就是促进社区治理的法治化,即实现常态化和规范化。在宪法学视域中,透视现代社区的内涵和特征,厘清社区组织的法律定位,梳理现行法律法规,提出法治化的实施方案,有助于开发社区治理的潜能。

In the process of promoting the construction of a law-based country,the importance of community governance is increasingly prominent.The modernization of national governance capacity and governance level aims to form an integrated system of national governance,social governance and community governance,and to bring community governance into the category of national governance system,which is conducive to improving the position of community governance and maintaining its synchronous development with the level of national governance.The essence of national governance is local governance,and local governance embodies community governance.Community governance is a vivid and concrete reflection of national governance at the grassroots level,and improving the community governance capacity and modernization level must be focused on.The concrete path is to promote the rule of law of community governance,i.e.,to achieve normalization and standardization.From the perspective of constitutional law,it is helpful to explore the potential of community governance to understand the connotation and characteristics of modern community,clarify the legal orientation of community organizations,sort out the existing laws and regulations,and put forward the implementation plan of rule by law.
