Comparative Study on Nuclear Safety Law and Biosafety Law

《生物安全法》对促进我国生物安全发展具有重要保障作用。通过对《核安全法》与《生物安全法》在立法、内容目标、相互关联方面的对比研究,得到相同点和差异点,即《生物安全法》作为基础性法律,采用与《核安全法》相同的立法模式,有利于提高在相关领域的系统性制度构建和统筹安排;相对于《核安全法》,《生物安全法》的立法目的不仅更加广泛和立体,并且在不同领域的倾向性也不同;相对于《核安全法》强调在核技术应用中保证安全,《生物安全法》更注重在保证安全的情况下应用生物技术;《生物安全法》的制定,将规范核技术于生物领域的应用,推动生物安全与核安全各自及良性互动健康发展。

Biosafety Lawplays an important role in promoting the development of biosafety in China.Through the comparative study on the legislation,content and objective,and correlation between Nuclear Safety Law and Biosafety Law,the paper obtains the similarities and differences as follows:Biosafety Law as a fundamental law,adopts the same legislative mode as Nuclear Safety Law,conducive to improving the systematic system construction and overall arrangement in relevant fields.Compared with Nuclear Safety Law,the legislative purpose of Biosafety Law is not only broader and more dimensional,but also has different tendencies in different fields.In contrast to Nuclear Safety Law’s emphasis on ensuring safety in the application of nuclear technologies,Biosafety Law focuses more on the application of biotechnology in the context of ensuring safety.The enactment of Biosafety Law will standardize the application of nuclear technology in the biological field and promote the healthy development of biosafety and nuclear safety through their respective and benign interactions.
