公证参与罪犯履行民事赔偿的新路探析

监狱主动融入国家建设和社会治理大局,和建立完善监狱工作的社会化支持体系是一个硬币的两个面。当前,监狱对罪犯财产性判项履行中存在法院拒收、被害人不接受等实际困难。公证机构积极介入并发挥罪犯履行民事赔偿的公证职能,具有其第三方机构的独立、公正、客观等天然优势。发挥公证在监狱工作社会化支持体系建设中的积极作用,促进监狱更好地履行惩罚犯罪、改造罪犯和稳定社会秩序功能,对于助推社会治理体系和治理能力现代化具有重要的现实意义。

The prison actively integrates into the overall situation of national construction and social governance,and establishes and improves the socialized support system of prison work.At present,there are some practical difficulties in the performance of prison’s property judgment,such as the court’s rejection and the victim’s rejection.Notarial organizations actively participate in and give full play to the notarization function of criminal in civil compensation,which has the natural advantages of independence,impartiality and objectivity of the third-party organization.It is of great practical significance to promote the modernization of social governance system and governance capacity to give full play to the positive role of notarization in the construction of prison work socialization support system and promote the prison to better perform the functions of punishing crimes,reforming criminals and stabilizing social order.
