浅谈欧洲药品专利期补偿制度的现状和发展趋势

我国近期正在加快完善药品专利保护,探索建立专利期限补偿制度。本文详细介绍欧洲特色的药品"专利期补偿制度"——补充保护证书(supplementary protection certificate,SPC),并根据对近年来涉及SPC的法院判决典型案例的梳理,分析了SPC制度发展中遇到的争议问题以及发展趋势。本文旨在能增进相关管理部门及业内人士对欧洲药品补充保护证书制度的了解,为我国药品专利保护制度的完善提供决策支持。

The Chinese government is improving the drug patent protection system and exploring the establishment of patent term compensation regulation.In this paper,supplementary protection certificate(SPC),the special patent term compensation system in Europe,was introduced in detail,and disputing questions and development tendency in the development of SPC were analyzed according to some typical court judgment cases on SPC in recent years.This paper aims to improve understanding of SPC for relevant management departments and professionals,and provide decision-making reference for improving the drug patent protection system in China.
