摘要 生态环境问题是全球性难题,环境治理形势严峻。实践中,环境规制制度落实难、执法低效问题仍十分严重。究本溯源,环境规制法律制度的实施实质上是各方规制主体的博弈过程。基于此,通过构建企业之间策略选择博弈模型、规制机构和被规制企业等博弈矩阵和模型,以环境规制制度实施效果为切入点,分析不同情形下,环境规制中各利益主体之间的博弈选择对规制效果的影响,并以此为基础,从完善法律体系、优化管理机制、加强监管监督,克服规制俘获、织密配套体系等方面提出对策建议,以期通过构建政府、企业等利益相关主体的良性博弈关系,提升环境规制效果,推动我国生态环境治理现代化建设。 The problem of ecological environment is a global problem,and the situation of environmental governance is severe.In practice,the problems of difficulty in implementing environmental regulations and inefficient law enforcement are still very serious.Tracing back to the source,the implementation of the legal system of environmental regulation is essentially a game process of the regulatory bodies of all parties.Based on this,through the construction of a strategy choice game model between enterprises,a game matrix and a model of regulatory agencies and regulated companies,the implementation effect of the environmental regulation system is taken as the starting point to analyze the game between the various stakeholders in environmental regulation under different circumstances choose the impact on the regulatory effect,and on this basis,put forward countermeasures and suggestions from improving the legal system,optimizing the management mechanism,strengthening supervision and supervision,overcoming regulatory capture,and weaving a supporting system,with a view to constructing government,enterprise and other stakeholders the benign game relationship between the two countries will enhance the effect of environmental regulation and promote the modernization of China’s ecological environment governance.
