网络赌球犯罪分析与侦查对策研究--以浙江省网络赌球案件为视角

Analysis of online gambling crimes and research on investigative countermeasures--From the perspective of online gambling cases in Zhejiang

近年来,一些犯罪团伙利用社会公众对足球的关注,建立起以足球赛事为主要玩法的网络赌球平台,企图从中牟利。网络赌球犯罪作为典型的非接触性犯罪,因其手法隐蔽、犯罪成本低、牟利大、形式多样等原因日益猖獗,严重危害了社会管理秩序,成为影响当前社会稳定的消极因素之一。为维护社会秩序,打击网络赌球犯罪,对中国裁判文书网收录的部分网络赌球犯罪裁判文书进行分析研究,基于文献计量法和内容分析法梳理出当前网络赌球犯罪侦查工作存在的发现难、追缴难、取证难和协作难困境,进而从线索来源、侦查理念、取证能力和侦查协作四个方面提出侦查对策,以期对网络赌球犯罪侦查工作有所裨益。

In recent years,some criminal gangs have used the public attention to football to establish an online gambling platform with football matches as the main gameplay in an attempt to profit from it.As a typical non-contact crime,online gambling crime is becoming more and more rampant due to its hidden tactics,low cost,high profit and various forms.It has seriously harmed the order of social management and has become one of the negative factors affecting the current social stability.In order to maintain social order and combat online gambling crimes,we analyze and research some judgment documents of the online gambling crimes collected by the website of Chinese judgment documents.Based on the bibliometric method and content analysis method,we sort out the dilemma in the investigation of current online gambling crime,such as the difficulties in finding,recovering,obtaining evidence and cooperation,and then propose investigative countermeasures from the four aspects of the source of clues,investigative concept,ability to obtain evidence and investigative cooperation,in order to benefit the investigation of online gambling crimes.
