摘要
传统劳动关系概念及劳动法,其判定标准强调人格和经济的双重从属性,共享经济业态下的劳动关系具有许多新的内涵,劳动关系理论及劳动法学在共享经济模式下面临巨大挑战。共享经济模式的出现对于当代劳动关系产生了深刻的影响,尤其体现在消费者参与管理、劳动者自主性增强、平台企业业务界限模糊化等方面。但传统劳动关系概念和判定标准具有较强的弹性和适应性,已然可以囊括网络共享经济模式下的劳动关系,这也符合法经济学的基本判断。通过理性选择,对于这种变化中的劳动关系法律要适时作出调整和补强,从社会保障等角度加以平衡,以建构符合新时代中国特色的和谐劳动关系。
The traditional concept of labor relations and labor law,whose criteria emphasize the dual subordination of personality and economy,have a lot of new connotations in the labor relations under the sharing economy.The theory of labor relations and labor law are facing great challenges under the sharing economy mode.The emergence of the sharing economy model has a profound impact on the contemporary labor relations,especially reflected in the participation of consumers in management,the enhancement of workers’autonomy,and the blurring of business boundaries of platform enterprises.However,the traditional concept and judgment standard of labor relations have strong flexibility and adaptability,which can already include the labor relations of network sharing economy mode,which is also in line with the basic judgment of legal economics.Through rational choice,the changing labor relations laws should be adjusted and strengthened in time,and balanced from the perspective of social security,so as to build a new era of Chinese characteristics color harmonious labor relations.
