融贯性解释在专业行政领域中的应用——以“突发疾病”工伤认定条款的解释为例

The Application of Coherent Interpretation in Profession Administration:Taking the Interpretation of the Article About the Identification of Work-Related“Sudden Illness”as an Example

对于"突发疾病"条款,行政机关倾向于审慎从严解释,法院则主张依据立法文本作对当事人有利的解释。专业行政领域是此问题的发生场域,该领域立法疏阔且滞后,行政主管部门规范解释空间较大,司法审查之专业性常常受到质疑,这些问题直接导致了上述解释冲突。融贯性解释理论有助于化解该领域存在的解释争议,主张规范解释要历经法律体系内部融贯、事实与规范融贯和主体间融贯三个阶段,方能充分释明条款。该理论可为专业行政领域确立融贯性解释标准、协调解释主体关系并推动事实与规范之视域融合。该理论之解释进路在于,先以法律解释方法充分揭示解释可能性,进而在事实与规范之间分类整合解释,最后生成融贯性解释结论,还可以在此基础上反思该立法应当如何完善。

The administrative organ tends to interpret the“sudden illness”article prudently and strictly,while the court advocates to interpret it in favor of the parties according to the legislative text.This conflict is caused since the interpretation occurred in the field of profession administration,and in this field,legislation is extensive and lagging behind,the administrative organ has a large power of interpretation,and the professionalism of judicial review has been questioned.Coherence interpretation theory can help to solve the conflict.It claims that formal and thorough interpretation of the article should go through three phases:the internal coherence of the legal system,the integration of facts and norms,and intersubjective coherence.This theory can establish a coherent interpretation standard for profession administrations,coordinate the relationship among the subjects that make interpretation,and promote the integration of facts and norms.The interpretation method of this theory can fully reveal the possibility of interpretation by means of legal interpretation,interpret on how to classify and integrate the facts and norms,and finally generate coherent interpretation conclusions.On this basis,the perfection methods of legislation can be reflected on.
