摘要 家庭教育对于个人成长和社会发展具有重要意义,需要进行专门立法进行规范和保障。家庭教育促进法的价值基础在于保障宪法第46条和第49条所确立的未成年子女受教育权和父母的家庭教育权。从十个省市的地方性法规到全国性立法,这一过程体现了国家从促进型立法、家庭教育概念界定和内容设置、家庭和国家的责任分配等方面履行促进家庭教育的宪法义务。家庭教育促进法的后续实施应注意与其他法规范和政策体系的有效衔接,创新家庭教育指导方式,并加强实施效果的监督和评估,以提升促进型立法的实效性。 Family education is significant for personal growth and social development and requires special legislation for specification and protection.Family Education Promotion Law is based on the value of the right to education of minor children and the family education right of parents,which are guaranteed by Articles 46 and 49 of the Constitution.The regional regulations of ten provinces and cities and national legislation have demonstrated that the constitutional obligation has been fulfilled from promoting legislation,stipulating concepts,the content of family education,and different responsibility of family and state.It is necessary to link up Family Education Promotion Law with other laws and policies,bring forth new ideas to inform pathways of family education guidance,and supervise and assess the enforcement effects.
