刑事速裁程序的检视与完善——以诉讼价值平衡论为视角

Inspection and Perfection of Criminal Expedited Procedure——From the Perspective of Litigation Value Balance Theory

刑事速裁程序的司法适用初步构建起认罪认罚制度下诉讼程序新体系,即繁简分流的梯度程序体系,然而其对于效率目标的实现却被正义和秩序要求所限制。作为刑事诉讼程序的新样态,理应在刑事诉讼价值框架中发展和完善。在对速裁程序存在问题和刑事诉讼价值理论学说进行梳理的基础上,将速裁程序置于诉讼价值平衡论下对相关缺憾进行价值问题转化。以刑事诉讼程序价值动态平衡为前提,整体深入探究诉讼活动程序正义与实体正义之关系,从结果层面确认实体正义超越程序正义之理论和实践可能性,并依此探究速裁程序相关问题解决路径。

The judicial application of criminal expedited procedure is applicable to the new system of litigation procedure under the preliminarily constructed system of confession and punishment,that is,the gradient procedure system of separating the simple from the complicated.But its realization of efficiency is restricted by the requirements of justice and order.As a new form of criminal procedure,it should be developed and perfected in the value framework of criminal procedure.On the basis of sorting out the existing problems of the expedited procedure and the theory of criminal procedure value,the relevant flaws are transformed in terms of values under the litigation value balance theory.On the premise of the dynamic balance of the value of criminal procedure,this paper probes into the relationship between procedural justice and substantive justice,confirms the theoretical and practical possibilities of substantive justice beyond procedural justice on the result level,and explores the solutions to the problems related to expedited procedure.
